In a significant legal milestone, Netflix has settled a privacy claim related to its 2022 documentary “Our Father,” with minimal financial consequence. The case stemmed from a video about Dr. Donald Cline, a fertility doctor whose unethical tactics startled many people. The jury ordered Netflix to pay $385,000 to one of the claimants, and the other claim was rejected.
The documentary focused on Dr Cline’s alarming behaviour, which included using his sperm to inseminate patients without their consent from 1974 until 1987. This revelation drew national attention to the topic of fertility fraud, resulting in a legal struggle between two ladies whose names appeared briefly in the film.
Lori Kennard and Sarah Bowling complained against Netflix for breach of privacy when their identities were revealed. The court granted Kennard $385,000, but Bowling’s claim was denied because of her earlier public statements about Cline on social media.
A US District Court Judge, Tanya Walton Platt concluded that Netflix did not engage in gross negligence. Within weeks of the documentary’s premiere on May 11, 2022, the firm quickly obscured the plaintiffs’ identities. They also depended on Blumhouse’s production team to handle any required permissions.
This case highlights the difficult legal context involving fertility fraud, which previously lacked significant legal protections. Dr. Cline, who is now 85 years old, has faced multiple civil cases and paid approximately $1.5 million to infants born as a result of his unethical actions. Despite the gravity of his activities, he was spared jail time due to legal constraints at the time of his wrongdoing.
The documentary was a critical assessment of Cline’s conduct, using DNA testing and personal accounts to show how he fathered nearly 100 children by fraudulently using his genetic material instead of the donor’s or intended father’s sperm.
