Donald Trump has revived a proposal to levy a 100% tariff on films produced outside the United States and imported for U.S. release, a move that could upend Hollywood’s global production model while colliding with trade law and practical enforcement limits. The renewed threat, delivered this week as part of a broader tariff push, did not include a timeline or implementing mechanism, but immediately prompted questions about whether a blanket duty on foreign-made features is workable—or legal.

Policy specialists note the White House has recently relied on a mix of authorities, including Section 232 of the Trade Expansion Act and emergency powers statutes, to reshape tariff policy. Even so, applying a 100% rate to “any and all movies” would confront hurdles ranging from the definition of an “imported” film in the digital era to treaty obligations that discourage duties on cross-border digital transmissions. Any measure broad enough to capture streaming titles risks conflict with World Trade Organization commitments and could trigger retaliation against U.S. content abroad.

Studios routinely shoot in Canada, the U.K. and Australia to tap incentives and specialized crews, then bring finished works home for theatrical or streaming distribution. A flat surcharge at the border could raise costs for global streamers and legacy studios while complicating co-productions with U.S. creative and financial control but foreign principal photography. Market analysts also warn of spillover effects on employment and ticket prices, especially if partners answer with duties on American releases or with new local-content rules.

Industry reaction, for now, has oscillated between alarm and skepticism. Some executives characterize the proposal as saber-rattling that will either narrow substantially in scope or stall in the rule-making weeds; others see a serious risk of policy-by-announcement chilling greenlights for projects that rely on international stages or tax rebates. The uncertainty alone has been enough to jolt entertainment stocks and prompt contingency planning around relocating shoots, redomiciling postproduction, or re-sequencing release strategies to limit “import” exposure.

The tariff talk also lands in the middle of fall festivals and awards positioning, injecting geopolitical risk into a calendar that depends on U.S. access for foreign titles and on overseas revenue for American ones. With no formal rule published, studios and guilds are modeling scenarios that range from carve-outs for treaty allies to a narrower focus on physical media and prints—none of which the administration has detailed publicly.
